You’re riding home from work after a very hectic day. While the bus/train lulls you to a state of semi-consciousness, you’re zapped and jolted to sudden alertness – you just had a light bulb moment! An idea, nay, a cutting-edge idea for a mobile app starts to germinate in your head. By the time you step inside your door, you’ve built the functionalities in your mind and already doing user testing in your head. You can see the graphics in your mind’s eye. You can mentally see the download counter and have started counting how much $$$ will land in your bank account.
Hang on! Let’s back track….how much ARE you getting for this app? How much are you charging? Must it really be a paid app? if you don’t charge for it, where do you then find the revenue from this entire exercise? Hmmmmm…..

So now you have this golden idea for a mobile app. You created, developed, tested, poked and stretched your app until it’s the shape and form you want it to be (not that it’s tangible, mind you). You publish it and wait. “Build it and they will come!” – you thought (in reference to Field of Dreams the movie, of course). So you waited and waited and waited…..but in the digital space where you’re one of tens of thousands of apps – in the AppStore, AppWorld, AppBrain, Android Market, etc., etc. – how do you get your app its 15 minutes of fame? How do you get heard in this vast mobile jungle?

You’ve finally launched your mobile app – bravo! Traffic has started to trickle in slowly but surely. Inevitably, you find yourself with a database of mobile numbers, and maybe even additional data that will allow you to do customer profiling or market segmentation. The question now is: what can you LEGALLY do with these? Can you send a broadbast to up-sell (was there an opt-in there somewhere? But they bought it so that was inferred consent, right??) Can you send them special offers (is it still spam even if I offer them something for free?). Can I even release the latest version with subliminal advertising (will I be accused of indirectly “selling” my database to 3rd party advertisers?)
